Disney Infinity 3.0 Fan’s Dream-Come-True Sweepstakes
OFFICIAL RULES
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN, NOR WILL A PURCHASE IMPROVE ONE’S CHANCES OF WINNING
1. SPONSOR: Disney Worldwide Services, Inc., dba D23 Worldwide, 500 South Buena Vista St., Burbank, CA 91521, is solely responsible for all aspects of this sweepstakes (“Sweepstakes”).
2. ELIGIBILITY: To be eligible for this Sweepstakes, at the time of entering you must: [A] be a legal resident of the 50 United States or the District of Columbia (collectively, “Territory”) who is physically located and residing therein; [B] be at least 18 years of age or older or the age of majority in your state of primary residence (whichever is older); and [C] be an active D23 Member prior to date of entry.
3. NO PURCHASE REQUIRED: Fans may join D23 for free at http://www.disneystore.com/d23-free-membership/mp/1341194/1001064/.
4. ENTRY: Beginning at 10:00 A.M. PT, October 14, 2015, and ending at 10:00 A.M. PT, October 30, 2015 (“Entry Period”), you may enter via the Internet by submitting your name (first and last), your email address and your D23 membership number on the web entry form located at https://d23.com/entry/disney-infinity-3-fans-dream-come-true-sweepstakes/ (“Entry”). For purposes of these Official Rules (“Rules”), all times and days are Pacific Time, Sponsor’s computer is the official clock, and time stamps for all entries will be determined by web entry form. Normal Internet access and usage charges imposed by your online service will apply.
5. PROCEDURES: All Entries must be received during the Entry Period. The potential winner (“Winner”) for the Sweepstakes will be chosen at random on or about October 30, 2015, from all eligible Entries received during the Entry Period. Odds of winning depend on the total number of eligible Entries received.
6. LIMITATIONS: Each entrant may submit only one (1) Entry during the Entry Period. In the event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed to be submitted by the person whose D23 membership number is entered on the web entry form. Entries by any method other than set forth above in Section 4 are void. Any use of automated or programmed methods of effecting Entry is prohibited. Neither the Sponsor or any of its affiliates or subsidiaries, nor any of its/their respective officers, directors, shareholders, employees, agents or representatives (individually and collectively, “Releasees”), are responsible for the following (even if caused by the negligence of any of the Releasees): [A] Entries from persons residing, or physically located, outside the Territory; [B] lost, interrupted or unavailable network, server or other connections; [C] miscommunications; [D] failed phone, computer hardware or software or telephone transmissions; [E] technical failures; [F] unauthorized human intervention; [G] traffic congestion; [H] garbled or jumbled transmissions; [I] undeliverable emails resulting from any form of active or passive email filtering; [J] insufficient space in entrant’s email account to receive email; or [K] other errors of any kind, whether due to electronic, human, mechanical, printing, production or technical errors or other causes. Each of such potential Entries will be disqualified. All applicable federal, state, local and municipal laws and regulations apply. Void where prohibited or restricted by law.
7. PRIZE: One (1) prize pack (the “Prize”) for the Winner consisting of the following:
A. One (1) Disney Infinity 3.0 Starter Pack (3.0 Edition). Approximate Retail Value (“ARV”) is $64.99. Starter Pack includes:
– one (1) Disney Infinity 3.0 Edition Video Game;
– one (1) Disney Infinity 3.0 Edition Base;
– two (2) Star Wars Figures: Ahsoka Tano and Anakin Skywalker;
– one (1) Star Wars Twilight of the Republic Play Set Piece; and
– one (1) Web Code Card
B. One (1) Disney Infinity 3.0 Edition: Disney/Pixar Inside Out Sadness Figure (ARV: $13.99);
C. One (1) Disney Infinity 3.0 Edition: Disney/Pixar Inside Out Disgust Figure (ARV: $13.99);
D. One (1) Disney Infinity 3.0 Edition: Mickey Mouse Figure (ARV: $13.99);
E. One (1) Disney Infinity 3.0 Edition: Minnie Mouse Figure (ARV: $13.99); and
F. One (1) Disney Infinity 3.0 Edition: Toy Box Expansion Games (ARV: $19.99).
Total ARV of the Prize is $140.94. Any depiction of the Prize is for illustrative purposes only. Prize is not redeemable for cash or transferable. No substitution allowed except, at Sponsor’s sole discretion, a prize of equal or greater value may be substituted. Sponsor will not replace any lost or stolen element of the Prize. Prize cannot be used in conjunction with any other promotion or offer. Prize elements cannot be separated. Only one (1) Prize is available to be won. Prize will be awarded, provided that a sufficient number of eligible Entries are received and Prize is validly claimed by November 4, 2015 after which no alternate Winner will be selected or unclaimed Prize awarded.
8. WINNER: The potential Winner will be sent an email by Sponsor within 48 hours after the Entry Period ends. In order to be declared a Winner, you must meet the eligibility requirements in Section 2 above, and you must respond to Sponsor’s email within three (3) days from original notification by sending your name, shipping address, birth date and phone number to Sponsor. At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate Winner may result from any of the following: [A] a potential Winner’s failure to respond to the notification within time period(s) specified by Sponsor; [B] the return of any notification or Prize as undeliverable; [C] a potential Winner’s failure to provide Sponsor with satisfactory proof of age, eligibility, identity and residency; [D] a potential Winner’s failure to validly claim the Prize by November 4, 2015; and [E] any other non-compliance with the Rules by a potential Winner. In the event of Prize forfeiture, the Sponsor may, in its sole discretion, award or not award the forfeited Prize to an alternate Winner, time permitting. Federal, state, and local taxes are the sole responsibility of the Winner.
9. PRIVACY POLICY/DATA COLLECTION: All personal information provided by you for these Sweepstakes is subject to Sponsor’s privacy policy located at http://disneyprivacycenter.com/privacy-policy/.
10. CONDITIONS: By entering this Sweepstakes and/or accepting the Prize (or any portion thereof) you may win, you agree that: [A] you will be bound by the Rules and the Sponsor’s decisions, which shall be final and binding in all respects; [B] the Entry will not be acknowledged or returned; [C] you release and hold harmless the Releasees from any and all liability for claims, injuries, losses or damages of any kind, including without limitation death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of the Prize; participation in this Sweepstakes or any Sweepstakes-related activity or travel or from any interaction with, or downloading of, computer Sweepstakes information; [D] the Releasees do not make any representation, warranty or guarantee, express or implied, relating to this Sweepstakes or the Prize; [E] the Winner’s acceptance of the Prize constitutes the grant to Sponsor and its assigns of an unconditional right to use the Winner’s name, address (city and state only), voice, likeness, photograph, biographical and Prize information, statements about the Sweepstakes and/or live and taped performances of interviews for any programming, publicity, advertising and promotional purposes without additional compensation, except where prohibited by law; [F] in the event viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism, or other matters beyond the Sponsor’s reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of this Sweepstakes, so that it cannot be conducted as originally planned, Sponsor has the right, in its sole discretion, to modify the Rules or to cancel, modify, terminate or suspend this Sweepstakes and, in such event, to select the Winner by such method as Sponsor in its sole discretion shall consider equitable; [G] the Releasees are not responsible for typographical or other errors in the offer or administration of this Sweepstakes, including but not limited to errors in the advertising, Rules, selection and announcement of the Winner and distribution of the Prize; [H] any portion of the Prize not accepted or used by the Winner will be forfeited; [I] the Releasees are not responsible for any inability of the Winner to accept or use the Prize (or any portion thereof) for any reason; [J] the Sponsor has the right, at any time and at its sole discretion, to disqualify any individual: (a) if the Sponsor suspects that individual to be doing any of the following: (i) tampering or attempting to tamper with the Entry process or the operation of this Sweepstakes; (ii) violating the Rules; (iii) violating the terms of service, privacy policy or other terms, conditions of use and/or general rules or guidelines of any Sweepstakes property or service; or (iv) acting in bad faith, unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; or (b) for any other good cause as determined solely by the Sponsor; [K] all disputes, claims and causes of action at law or in equity (individually, “Claim”) arising out of or relating to this Sweepstakes, the meaning or interpretation of the Rules or the Prize awarded shall be resolved by applying the laws of California, without regard to conflict of laws provisions therein, and shall be solely and exclusively brought in the state or federal courts within that state; [L] any Claims shall be resolved individually, without resort to any form of class action; and [M] Sponsor has the right to modify Prize award procedures at its sole discretion.
