BY SIGNING THE GUEST LIST SHEET, YOU ACKNOWLEDGE AND AGREE:
NOTICE: “SKATE AT YOUR OWN RISK” Roller skating is a participation sport. There are certain risks which are associated with the sport of roller skating. When skating, you can fall for many different reasons. You can fall when you make contact from another skater. You can fall when you lose your balance to your own inability to skate. Because of the normal risks of roller skating and maintaining one’s balance, you realize that when you roller skate, you are assuming such risks. We are not responsible for any injuries which we cannot control due to impulse or spontaneous actions of a person which may cause you to fall. Every effort is maintained to keep skaters orderly and provide safety within our control.
In consideration of being allowed to participate in any way in this program, related events and activities. I undersigned, acknowledge, appreciate and agree that:
The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist and, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for my participation; and I, willingly agree to comply with the stated and customary terms and conditions for participation. If however I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest officials immediately and, I, for myself and on behalf of my heirs, assigns, personal representatives and the next of kin, HEREBY RELEASE, INDEMNITY, AND HOLD HARMLESS THE “MOONLIGHT ROLLERWAY, D23 AND THE WALT DISNEY COMPANY (TOGETHER WITH D23, “DISNEY”), DISNEY’S SUBSIDIARIES AND AFFILIATES, and each of their officers, directors, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (RELEASEES), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss of damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
I HAVE READ THIS PARTICIPANT RELEASE OF LIABILITY , FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING THE GUEST SHEET, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
